CardChain Terms of Service
IMPORTANT NOTICE
PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE USING CARDCHAIN. BY CREATING AN ACCOUNT, ACCESSING, OR USING OUR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE CARDCHAIN.
1. ACCEPTANCE OF TERMS
1.1 Agreement to Terms
By accessing or using the CardChain mobile application, website, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations.
1.2 Modifications
CardChain reserves the right to modify these Terms at any time. We will notify you of material changes via email or in-app notification at least 30 days before the changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.
1.3 Additional Terms
Certain features of the Service may be subject to additional terms and conditions, which will be presented to you at the time you access those features. Those additional terms are incorporated into these Terms by reference.
2. ELIGIBILITY AND ACCOUNT REGISTRATION
2.1 Age Requirements
- You must be at least 13 years old to create an account.
- Users under 18 may use CardChain for viewing, portfolio tracking, and purchasing only.
- You must be at least 18 years old to independently sell cards on the marketplace.
- Users ages 13-17 may sell cards ONLY if a parent or legal guardian creates and manages the seller account, connects their bank account, and handles all shipping and transactions on behalf of the minor.
- Users under 13 are prohibited from using the Service in compliance with the Children's Online Privacy Protection Act (COPPA).
2.2 Account Creation
To access certain features, you must create an account by providing:
- Valid email address
- Username (subject to availability and our Community Guidelines)
- Password meeting our security requirements
- Optional: Social login via Apple, Google, or other supported providers
2.3 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying CardChain immediately of any unauthorized access
- Using strong passwords and enabling two-factor authentication when available
2.4 Account Accuracy
You agree to provide accurate, current, and complete information during registration and to update such information as necessary. Providing false information may result in account suspension or termination.
2.5 One Account Per Person
You may maintain only one active account. Creating multiple accounts to circumvent restrictions, manipulate ratings, or engage in fraudulent activity is prohibited.
3. DESCRIPTION OF SERVICE
3.1 Platform Overview
CardChain is a peer-to-peer marketplace and portfolio management platform for sports trading cards. Our Service includes:
Portfolio Management:
- Digital tracking of your card collection
- Real-time market value estimates
- Investment performance analytics
- Price alerts and notifications
Marketplace:
- Buying and selling sports cards between users
- AI-powered listing creation and pricing assistance
- Integrated payment processing via Stripe
- Shipping rate calculation and label generation
AI Features:
- Card recognition and identification
- Automated grading assessment (estimated only)
- Market value predictions
- Listing optimization recommendations
Social Features:
- Public user profiles
- Following other collectors
- Messaging and offers
- Ratings and reviews
3.2 Platform Role
CardChain is a marketplace platform that connects buyers and sellers. We are not a party to transactions between users. Contracts for sale are formed directly between buyers and sellers. CardChain does not own, sell, or possess the trading cards listed on the platform.
4. AI-POWERED FEATURES AND DISCLAIMERS
4.1 AI Analysis Services
CardChain uses artificial intelligence services provided by third-party AI providers to provide:
- Card identification and recognition
- Condition and grading estimates
- Market value predictions
- Listing descriptions and pricing recommendations
4.2 AI and Market Data Accuracy Disclaimer
IMPORTANT: AI ANALYSIS AND MARKET DATA ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND ARE NOT GUARANTEED TO BE ACCURATE.
You acknowledge and agree that:
- No Warranty of Accuracy: AI analysis and market pricing data are estimates only and may be inaccurate, incomplete, or outdated.
- Not Professional Grading: AI grading is not a substitute for professional grading services (PSA, BGS, SGC, etc.).
- No Investment Advice: AI pricing predictions and market data are not financial or investment advice. You should conduct your own independent research before making any buying or selling decisions.
- User Assumes All Risk: You assume all risk from relying on AI features and market data. CardChain is not responsible for any losses, damages, or financial decisions resulting from AI inaccuracies or incorrect market data.
- Your Judgment Only: All financial decisions are made solely at your own discretion and judgment. Do not rely on CardChain's AI or market data as the sole basis for any transaction.
- Continuous Changes: AI models and market data are continuously updated and may produce different results over time.
4.3 User Responsibility
When using AI features, you are responsible for:
- Verifying AI analysis independently before making purchasing or selling decisions
- Disclosing AI-generated information in listings when applicable
- Not misrepresenting AI estimates as professional grading
- Understanding that AI cannot authenticate cards or detect counterfeits
4.4 Third-Party AI Providers
AI services are provided by third-party vendors. Use of AI features is also subject to those providers' terms of service. CardChain is not responsible for third-party AI service interruptions, errors, or changes.
5. MARKETPLACE TERMS - GENERAL
5.1 Buyer and Seller Relationship
Transactions on CardChain are contracts between individual buyers and sellers. CardChain facilitates these transactions but is not a party to them and bears no liability for disputes arising from transactions.
5.2 Payment Processing
All payments are processed through Stripe, a third-party payment processor. By using the marketplace, you agree to:
- Stripe's Services Agreement and Connected Account Agreement
- CardChain's collection of transaction fees
- Payment processing fees charged by Stripe
- Applicable tax collection and remittance
5.3 Fees
For Buyers:
- No listing browsing fees
- No transaction fees or payment processing fees
- Optional subscription fees for premium features (Pro tier: $4.99/month)
For Sellers:
- Transaction fee: 7% + $0.30 per sale (deducted from seller payout)
- This fee covers all payment processing costs
- Optional promotion/featured listing fees (if applicable)
Example: On a $100 sale, the seller receives $92.70 ($100 - 7% - $0.30 = $92.70)
All fees are subject to change with 30 days' notice.
5.4 Taxes
Users are responsible for determining and paying all applicable taxes (sales tax, income tax, etc.) arising from their transactions. CardChain may collect and remit sales tax where required by law. Sellers who meet IRS thresholds will receive Form 1099-K for tax reporting purposes.
6. SELLER OBLIGATIONS
6.1 Seller Onboarding
To sell on CardChain, you must:
- Be at least 18 years old
- Complete seller verification (identity verification via Stripe)
- Provide valid bank account information for payouts
- Accept the Seller Agreement (supplemental to these Terms)
- Provide accurate contact and shipping address information
- Comply with all applicable laws and regulations
6.2 Listing Requirements
When creating listings, sellers must:
Accuracy:
- Provide truthful, accurate, and complete descriptions
- Accurately represent card condition using industry-standard grading terms
- Disclose all defects, alterations, or restoration
- Use authentic, unaltered photographs of the actual card being sold
- Not misrepresent grading (e.g., claiming PSA 10 without certificate)
Prohibited Items:
- Counterfeit or altered cards
- Cards that violate intellectual property rights
- Stolen property
- Items prohibited by law or these Terms
Pricing:
- Set reasonable prices based on market conditions
- Not engage in price manipulation or collusion
- Honor listed prices when buyers commit to purchase
6.3 Shipping Obligations
Sellers must:
- Ship items within the specified handling time selected when creating the listing (default: 3 business days if not specified)
- Use shipping methods selected during listing creation
- Provide tracking information to buyers
- Package items securely to prevent damage
- Ship to the exact address provided by the buyer
- Purchase insurance for high-value items at seller's discretion (recommended for items >$250)
6.4 Communication
Sellers must:
- Respond to buyer messages within 24-48 hours
- Provide updates on shipping delays
- Work in good faith to resolve disputes
- Maintain professional and courteous communication
6.5 Prohibited Seller Practices
Sellers may not:
- Engage in shill bidding or price manipulation
- Create fake reviews or ratings
- Solicit off-platform transactions to avoid fees
- Misrepresent card authenticity or grading
- Sell the same card in multiple listings simultaneously
- Cancel transactions without valid cause after buyer commitment
- Engage in bait-and-switch tactics
7. BUYER OBLIGATIONS
7.1 Payment Commitment
By clicking "Buy Now" or submitting an offer that is accepted, you enter into a binding contract to purchase the item at the specified price. You agree to:
- Provide valid payment information
- Complete payment immediately upon commitment
- Not cancel orders without valid cause
- Pay all applicable taxes and fees
7.2 Shipping Address
Buyers must:
- Provide accurate and complete shipping addresses
- Ensure someone is available to receive packages
- Update address information before completing purchases
- Accept responsibility for packages delivered to the provided address
7.3 Inspection and Acceptance
Upon receiving an item, buyers must:
- Inspect the item within 3 calendar days of delivery
- Report any discrepancies or damage to the seller immediately
- Open a buyer protection claim within 3 calendar days of delivery for automatic protection coverage
- After 3 days, buyers may still submit a dispute to CardChain support (within 30 days of delivery), but resolution is at CardChain's discretion and not guaranteed
- Not file chargebacks without first attempting to resolve with the seller and CardChain
7.4 Prohibited Buyer Practices
Buyers may not:
- Make purchases without intent to pay
- File false claims or disputes
- Attempt to switch items and claim damage
- Harass sellers or leave retaliatory reviews
- Engage in fraudulent chargeback activity
8. PAYMENT AND PAYOUT TERMS
8.1 Stripe Integration
CardChain uses Stripe Connect for payment processing and seller payouts. By using the marketplace, you agree to:
- Stripe's Services Agreement: https://stripe.com/legal/ssa
- Stripe's Connected Account Agreement: https://stripe.com/legal/connect-account
- CardChain's use of Stripe to collect and distribute funds
8.2 Buyer Payments
- Payments are processed immediately upon purchase
- Funds are held in escrow until delivery confirmation or after a hold period
- Payment methods: Credit card, debit card, Apple Pay, Google Pay (subject to availability)
- All payments are in USD
8.3 Seller Payouts
- Payouts are issued via Stripe to your connected bank account
- Payout schedule: Funds are released when delivery is confirmed and the buyer receives the item
- Funds are held during the 3-day buyer protection period
- Minimum payout amount: $1.00
- Payouts may be delayed or held for risk review, disputes, or fraud investigations
8.4 Payment Holds
CardChain or Stripe may hold funds if:
- There are disputes or claims regarding the transaction
- Fraud or policy violations are suspected
- The seller's account is new or has performance issues
- Required by law or payment processor requirements
8.5 Refunds and Cancellations
Buyer-Initiated:
- Buyers may cancel orders before the seller ships the item
- Refunds for buyer protection claims are issued at CardChain's discretion based on our Buyer Protection Policy
- Refunds are processed through the original payment method
- Processing time: 5-10 business days
- Partial refunds may be issued for damaged items buyers choose to keep
Seller-Initiated:
- Sellers may voluntarily offer refunds at any time
- Sellers may cancel orders before shipping
- Sellers may offer partial refunds for item issues
9. SHIPPING AND DELIVERY
9.1 Seller Responsibility
Sellers are responsible for shipping items to buyers and bear the risk of loss or damage until delivery confirmation.
9.2 Shipping Integration
CardChain partners with shipping service providers to provide:
- Real-time shipping rate calculations
- Label purchase and printing
- Tracking integration
- Address validation
9.3 Shipping Costs
- Shipping costs are determined by seller's selected shipping methods
- Buyers pay shipping costs separately (unless seller offers free shipping)
- Sellers may not charge excessive shipping fees
9.4 Delivery Confirmation
- All shipments should include tracking
- Delivery is considered complete when tracking shows "delivered"
- If tracking shows "delivered" but the buyer claims non-receipt, the buyer should contact the shipping carrier or submit a support ticket to CardChain for review
9.5 Lost or Damaged Packages
- Sellers should purchase insurance for high-value items
- Claims for lost/damaged items should be filed with the carrier
- CardChain may mediate disputes but is not responsible for carrier issues
9.6 International Shipping
- CardChain currently only supports shipping within the United States
- International shipping is not available at this time
- This policy may change in the future with advance notice
10. BUYER PROTECTION POLICY
10.1 Coverage
CardChain provides limited buyer protection for:
- Item Not Received: Tracking shows no delivery within expected timeframe
- Item Not as Described: Card significantly differs from listing description
- Damaged in Transit: Item arrives damaged (with proper packaging evidence)
- Counterfeit Items: Item is determined to be counterfeit (with expert verification)
10.2 Filing a Claim
Automatic Buyer Protection (Within 3 Calendar Days):
To file a buyer protection claim with automatic coverage:
- Contact the seller within 3 calendar days of delivery (or expected delivery date)
- Attempt to resolve directly with seller
- If unresolved, open a claim via CardChain support within 3 calendar days of delivery
- Provide evidence (photos, messages, tracking information)
- Await CardChain investigation (typically 5-7 business days)
Discretionary Review (4-30 Days After Delivery):
- Buyers may submit disputes to CardChain support up to 30 days after delivery
- These disputes are reviewed at CardChain's sole discretion and resolution is not guaranteed
- Submit a support ticket via the Help/Support page with evidence
- CardChain will investigate and make a final determination
10.3 Exclusions
Buyer protection does NOT cover:
- Buyer's remorse or change of mind
- Subjective grading disputes (e.g., "I think it's a PSA 10, not a 9")
- Minor condition differences accurately disclosed
- Delayed shipping beyond seller's control (weather, carrier delays)
- Items accurately described as "altered" or "restored"
- Damage caused by buyer after delivery
10.4 Resolution Options
If a claim is approved, CardChain may:
- Issue a full refund (buyer returns item at seller's expense)
- Issue a partial refund (buyer keeps item)
- Require seller to replace the item
- Seller is responsible for return shipping costs if the claim is approved in the buyer's favor
10.5 Fraudulent Claims
Buyers who file false or fraudulent claims may have their accounts suspended or terminated.
11. RATINGS, REVIEWS, AND SELLER PERFORMANCE
11.1 Rating System
Users may rate and review transactions. Ratings are based on:
- Item accuracy
- Communication
- Shipping speed
- Overall experience
11.2 Review Guidelines
Reviews must:
- Be honest and based on actual experience
- Not contain profanity, threats, or personal attacks
- Not reveal personal information
- Not be used for extortion or revenge
11.3 Seller Performance Metrics
CardChain tracks seller performance including:
- Average rating
- Response time
- Shipping time
- Dispute rate
- Cancellation rate
11.4 Performance-Based Actions
Sellers with poor performance may face:
- Warning notifications
- Reduced visibility in search
- Account restrictions
- Temporary suspension
- Permanent termination
11.5 Disputing Reviews
Sellers may dispute reviews if they:
- Contain false information
- Violate review guidelines
- Were left by fraudulent buyers
- Relate to issues beyond seller's control (e.g., carrier delays)
CardChain will investigate disputes and may remove reviews that violate our policies.
12. SUBSCRIPTION SERVICES
12.1 Subscription Tiers
CardChain offers optional subscription plans:
Free Tier:
- Access to all core features (portfolio tracking, marketplace, buying, selling)
- Ad-supported experience
Pro Tier - $4.99/month:
- Ad-free experience
- Access to all core features
- Additional premium features (to be determined)
Pricing and features are subject to change with 30 days' notice.
12.2 Billing and Renewal
- Subscriptions are billed monthly or annually based on your selection
- Auto-Renewal: Subscriptions automatically renew unless cancelled
- Billing occurs on the anniversary of your subscription start date
- Payment is processed through Stripe or mobile app stores (Apple, Google)
12.3 Cancellation
- You may cancel your subscription at any time through account settings
- Cancellation takes effect at the end of the current billing period
- No refunds are provided for partial months/years
- Access to premium features continues until the end of the paid period
12.4 Free Trials
- Free trial offers are available to new subscribers only
- You must provide payment information to start a trial
- Trials convert to paid subscriptions automatically unless cancelled before trial end
- One free trial per user
12.5 Mobile App Subscriptions
Subscriptions purchased through mobile app stores (Apple App Store, Google Play) are subject to those platforms' terms and refund policies. Manage those subscriptions through the respective app store.
13. INTELLECTUAL PROPERTY
13.1 CardChain Intellectual Property
All content, features, and functionality of the Service, including but not limited to:
- Software code and architecture
- User interface design and graphics
- CardChain logos, trademarks, and branding
- AI models and algorithms
- Database structure and data compilations
are owned by CardChain, its licensors, or other content providers and are protected by copyright, trademark, patent, and other intellectual property laws.
13.2 Limited License to Users
CardChain grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.
You may NOT:
- Copy, modify, or create derivative works of the Service
- Reverse engineer, decompile, or disassemble the software
- Remove copyright or proprietary notices
- Use the Service for commercial purposes without authorization
- Frame or mirror any part of the Service
- Use automated systems (bots, scrapers) to access the Service
13.3 User-Generated Content
License Grant to CardChain:
By posting content on CardChain (listings, photos, reviews, messages, profile information), you grant CardChain a worldwide, non-exclusive, royalty-free, transferable license to:
- Display, reproduce, and distribute your content on the Service
- Use your content for marketing and promotional purposes
- Create derivative works for operational purposes (e.g., resizing images)
- Sublicense your content to service providers (e.g., CDN, cloud storage)
Content Ownership:
You retain ownership of content you post. This license does not transfer ownership to CardChain.
Content Responsibility:
You are solely responsible for content you post. You represent and warrant that:
- You own or have rights to the content
- Content does not infringe third-party intellectual property rights
- Content complies with these Terms and applicable laws
13.4 Copyright Infringement (DMCA)
CardChain respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA).
Filing a Copyright Claim:
If you believe content on CardChain infringes your copyright, send a DMCA notice to our Copyright Agent:

- Identification of the infringing material (URL or listing ID)

- Statement of good faith belief that the use is not authorized

Counter-Notice:
If your content was removed due to a DMCA claim and you believe it was removed in error, you may file a counter-notice following DMCA procedures.
Repeat Infringers:
Users who repeatedly infringe copyrights will have their accounts terminated.
13.5 Trademark Policy
You may not use CardChain trademarks without prior written permission. You may not use others' trademarks in a way that creates confusion or infringes their rights.
14. PROHIBITED CONDUCT AND CONTENT
14.1 General Prohibitions
You agree NOT to:
Illegal Activities:
- Violate any local, state, federal, or international laws
- Engage in fraud, theft, or money laundering
- Sell stolen property
- Facilitate illegal activities
Platform Abuse:
- Interfere with the operation of the Service
- Bypass security measures or access controls
- Introduce viruses, malware, or harmful code
- Overload servers or disrupt service availability
- Use automated systems without authorization (bots, scrapers, crawlers)
User Harm:
- Harass, threaten, or abuse other users
- Impersonate others or create fake accounts
- Stalk or invade privacy
- Discriminate based on protected characteristics
- Engage in hate speech or incite violence
Transaction Fraud:
- List counterfeit, altered, or fake cards (CardChain cannot track or detect counterfeits, but sellers found selling counterfeits during disputes will be held responsible)
- Misrepresent card condition or grading
- Engage in shill bidding or price manipulation (CardChain cannot actively monitor price manipulation, but violators will be penalized if discovered)
- Create fake sales to inflate ratings
- Coordinate with others to manipulate markets
- Engage in card trimming, restoration, or alteration without disclosure
Platform Manipulation:
- Create multiple accounts to circumvent rules
- Manipulate search rankings or visibility
- Leave fake or coerced reviews
- Solicit off-platform transactions to avoid fees
- Share or sell account access
14.2 Prohibited Content
You may not post content that:
- Infringes intellectual property rights
- Contains viruses or malicious code
- Is obscene, pornographic, or sexually explicit
- Promotes violence or illegal activities
- Contains personal information of others without consent
- Is spam or unsolicited advertising
- Violates our Community Guidelines
14.3 Enforcement
Violations may result in:
- Content removal
- Warning notifications
- Account suspension (temporary or permanent)
- Account termination/ban
- Forfeiture of funds
- Legal action
- Reporting to law enforcement
Reporting Violations:
- Users can report suspected violations by submitting a support ticket via the Help/Support page
- CardChain moderators will review reports on a case-by-case basis
- There is no automated strikes system; enforcement decisions are made individually based on severity
Account Bans:
- Banned users are prohibited from creating new accounts
- CardChain reserves the right to investigate violations and take appropriate action in its sole discretion
15. TERMINATION
15.1 Termination by User
You may terminate your account at any time through account settings or by contacting support. Upon termination:
- Active listings will be removed
- Pending transactions must be completed
- Outstanding payment obligations remain due
- Access to the Service will be revoked
15.2 Termination by CardChain
CardChain may suspend or terminate your account at any time, with or without notice, if:
- You violate these Terms
- You engage in fraudulent or illegal activity
- Your account poses a security risk
- Required by law or legal process
- CardChain ceases operations
15.3 Effect of Termination
Upon termination:
- Your license to use the Service ends immediately
- CardChain may delete your account and data
- Pending transactions will be handled according to our policies
- Outstanding fees and payments remain due
- Provisions that should survive termination will continue (e.g., liability limitations, indemnification)
15.4 Data After Termination
After account deletion:
- Personal data will be deleted within 90 days (subject to legal retention requirements)
- Transaction records may be retained for tax and legal compliance (7 years)
- Anonymized data may be retained for analytics
- Backup data will be deleted according to our retention schedule
16. DISPUTE RESOLUTION
16.1 Informal Resolution
Before filing a legal claim, you agree to contact CardChain to attempt informal resolution:

Provide a description of the dispute and your desired resolution. We will attempt to resolve disputes within 30 days.
16.2 Governing Law and Jurisdiction
These Terms and any disputes arising from or relating to them or the Service will be governed by the laws of the State of Delaware, without regard to conflict of law principles.
16.3 Venue and Jurisdiction
Any legal action or proceeding arising from or relating to these Terms or the Service must be brought exclusively in the state or federal courts located in Delaware. You consent to the personal jurisdiction of those courts and waive any objection to venue in those courts.
16.4 Small Claims Court
Notwithstanding the above, either party may bring an individual action in small claims court if the claim qualifies.
16.5 No Class Actions
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive the right to participate in class actions.
17. DISCLAIMERS AND WARRANTIES
17.1 "AS IS" Service
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
CardChain disclaims all warranties, including:
- Warranties of merchantability, fitness for a particular purpose, and non-infringement
- Warranties regarding accuracy, reliability, or availability of the Service
- Warranties that the Service will be uninterrupted, secure, or error-free
- Warranties regarding user-generated content or third-party services
17.2 No Guarantee of Results
CardChain does not guarantee:
- That you will successfully buy or sell cards
- The accuracy of AI analysis, pricing, or grading estimates
- The authenticity or condition of cards listed by users
- That transactions will be completed without disputes
- That the Service will meet your specific requirements
17.3 Third-Party Services
CardChain integrates with third-party services (Stripe, shipping providers, AI providers, etc.). We are not responsible for:
- Third-party service availability or performance
- Third-party terms of service or privacy policies
- Errors or changes to third-party services
- Third-party fees or charges
17.4 User Responsibility
You are solely responsible for:
- Evaluating the accuracy and reliability of information on the Service
- Verifying card authenticity and condition before purchasing
- Conducting your own research before making financial decisions
- Complying with laws and regulations in your jurisdiction
- Backing up important data related to your account
17.5 Investment Risk
Trading cards are speculative investments. CardChain does not provide investment advice. You assume all risk of:
- Loss of value
- Inability to resell
- Market volatility
- Counterfeit or altered cards
- Damage or loss during shipping
18. LIMITATION OF LIABILITY
18.1 Liability Cap
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARDCHAIN'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF:
- $100 USD, OR
- The total fees you paid to CardChain in the 12 months preceding the claim
18.2 Excluded Damages
CARDCHAIN WILL NOT BE LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Lost profits, revenue, data, or business opportunities
- Damages arising from user-generated content or third-party services
- Damages from unauthorized access to your account
- Damages from errors, bugs, or service interruptions
- Damages from reliance on AI analysis or pricing estimates
This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, etc.) and even if CardChain was advised of the possibility of such damages.
18.3 Exceptions
Some jurisdictions do not allow limitation of liability for certain damages. If your jurisdiction prohibits these limitations, they may not apply to you.
18.4 Transaction Disputes
CardChain is not liable for disputes between buyers and sellers. Users transact at their own risk. CardChain may facilitate dispute resolution but has no obligation to do so.
19. INDEMNIFICATION
19.1 Your Indemnification Obligation
You agree to indemnify, defend, and hold harmless CardChain, its affiliates, officers, directors, employees, agents, and licensors from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any laws or regulations
- Your infringement of third-party rights (intellectual property, privacy, etc.)
- Content you post on the Service
- Transactions with other users
- Your negligence or willful misconduct
19.2 Defense and Settlement
CardChain reserves the right to assume exclusive defense and control of any matter subject to indemnification. You agree to cooperate with CardChain's defense and not settle any claim without CardChain's prior written consent.

Your use of the Service is also governed by our Privacy Policy, incorporated into these Terms by reference. By using the Service, you consent to our collection, use, and disclosure of information as described in the Privacy Policy.

21. INTERNATIONAL USERS
21.1 United States Service Only
- CardChain is operated from the United States and incorporated in Delaware
- The Service is currently only available to users in the United States
- Shipping is only available within the United States
21.2 International Access
If you access the Service from outside the United States, you are responsible for compliance with local laws. CardChain makes no representation that the Service is appropriate or available in all locations.
21.3 Export Control and Compliance
You may not use or otherwise export or re-export the CardChain mobile application or Service except as authorized by United States law and the laws of the jurisdiction in which the Service was obtained.
In particular, but without limitation, the CardChain application may not be exported or re-exported:
- (a) into any U.S.-embargoed countries, or
- (b) to anyone on the U.S. Treasury Department's Specially Designated Nationals List or the U.S. Department of Commerce Denied Persons List or Entity List.
By using the Service, you represent and warrant that:
- You are not located in any such country or on any such list
- You will not use the Service for any purposes prohibited by United States law, including, without limitation, the development, design, manufacture, or production of nuclear, missile, or chemical or biological weapons
21.4 U.S. Government End Users
The CardChain mobile application and related documentation are "Commercial Items", as that term is defined at 48 C.F.R. §2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation", as such terms are used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202, as applicable.
Consistent with 48 C.F.R. §12.212 or 48 C.F.R. §227.7202-1 through 227.7202-4, as applicable, the Commercial Computer Software and Commercial Computer Software Documentation are being licensed to U.S. Government end users:
- (a) only as Commercial Items, and
- (b) with only those rights as are granted to all other end users pursuant to the terms and conditions herein.

22. MISCELLANEOUS PROVISIONS
22.1 Entire Agreement
These Terms, together with the Privacy Policy and any supplemental agreements, constitute the entire agreement between you and CardChain regarding the Service.
22.2 Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.
22.3 Waiver
CardChain's failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
22.4 Assignment
You may not assign or transfer these Terms without CardChain's prior written consent. CardChain may assign these Terms without restriction.
22.5 Force Majeure
CardChain is not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, government actions, or internet/telecommunications failures.

Section headings are for convenience only and do not affect interpretation.

CardChain may provide notices via email, in-app notification, or posting on the Service. You must provide notices to legal@cardchain.ai.
22.8 Language
These Terms are written in English. Any translations are for convenience only. In case of conflict, the English version controls.
